Last month I wrote about the seemingly never ending saga over the estate of J. Howard Marshall II – the late husband of starlet Anna Nicole Smith. Last week, the 9th Circuit Court denied Smith’s lawyers the opportunity to waste any more of the 9th Circuit’s time on this case.

As with every step of the way in this case, there’s more. Smith’s lawyers now have 90 days to file an appeal to return the case to the Supreme Court. If the court were to accept their petition, it would mark the second time the highest court in the land has considered this absurdly frivolous suit.

Smith’s lawyers have never been able to escape the facts in this case though, and maybe they’ve finally reached the end of the road. Of course, with millions of dollars in contingency fees on the line, I doubt they’ll pass up the opportunity to waste more of the court’s time if given the chance.

Still, it’s possible that after 15 years, this case is finally about to get its much-deserved stake through the heart.

• Congratulations to Navy SEAL Matt McCabe who was cleared yesterday of charges that he gave a captured terrorist – the mastermind behind the Fallujah murder of those Blackwater employees – a fat lip and a punch to the stomach. Two other SEALs in the incident had already been cleared.

• And while we’re happy with the results of these trials, those men never should have been charged in the first place. The military’s top brass who put them through this ordeal ought to be ashamed of themselves.

• The Smoking Gun reports that “A Transportation Security Administration (TSA) screener is facing an assault rap after he allegedly beat a co-worker who joked about the size of the man’s genitalia after he walked through a security scanner.” The screener and his co-workers had been training with new “whole body image” machines which provide very revealing images of a traveler.

• “The X-ray revealed that [the screener] has a small penis and co-workers made fun of him on a daily basis,” according to the police report filed in the case. The screener said “could not take the jokes anymore and lost his mind.” So he pulled out a police baton and beat a the co-worker in an airport parking lot on Tuesday.

• Don’t you feel much safer flying now?

As you read yesterday I’m officially changing my party registration to Republican so I can vote in the GOP primary on June 8th. Depending on who the party nominates, I’ll either stay Republican or switch back to independent (current odds are 20-1 in favor of switching back). But that’s not the purpose of noting this again today.
